All discounts/coupons received at the initial visit have been applied to this proposal.

Any coupons/flyers/web ads/ or other discounts etc., presented after the initial visit will not be part of this proposal and cannot be used to discount this portion of the project.

Any discounts or coupons presented after this point may be used for any additional work.

By signing below, pressing the accept button, or responding yes to the email, you are agreeing to the terms and conditions herein. Information provided in this agreement is an estimate.

Any changes necessary to properly complete your project or any additions requested by the client may be added to the total.

The customer will be contacted about deviations from the original proposal for the adjustment of price. A Better Edge, Inc. will complete all work in a good and workmanlike manner according to industry standards (or perhaps better!).

If you think we are great and decide you want us to do more, additional work requested by you (the client) should be agreed upon in writing. However, if agreed only verbally, you should still pay us for the additional work.

The work is contingent upon strikes, accidents, or delays beyond our control (including but not limited to soil conditions).

A Better Edge, Inc. shall provide workman’s compensation and general liability insurance.

Concrete installation: The client is asked to provide an electrical hookup (we use shop-vacs for clean-up and paint sprayers for sealant) and a water supply (to mix and/or clean up our awesome concrete mix). We are asking that you, the Client, provide us with all water necessary for the mixing, placement, and cleanup of concrete. Most often, a hose connection somewhere close is sufficient. Where water is not available, we ask that you work with us to obtain sufficient quantities so as to allow us to properly perform our work. This might include asking a neighbor to provide the water or paying for water delivery. We want your concrete to last as long as possible. In order to make sure we have adequate curing of our cement products, we ask that you not use irrigation systems for 2 days from the time of installation. Hard water or chemicals in city and well water may inhibit the curing process and could add to long-term curing issues or efflorescence. (See note on efflorescence below.) ABE will provide an estimate to the customer. ABE will use the customer’s verbal description to approximate as closely as possible the described layout; however, ABE will not be responsible for any changes in design, color, or location after the installation has begun. If the customer requests changes to any or all portions of completed work, the customer will be responsible for the original and changed installation cost.

Scheduling terms: A Better Edge supplies concrete edging and features to our clients on a first-come, first-served basis. When we receive a deposit for work, the project is placed in our installation queue. All estimates of schedule are approximate and are very likely to change according to weather, employment conditions, and/or equipment malfunction, etc. Clients should expect their proposed date of installation to change based on the above considerations. The customer understands that a start date cannot be guaranteed. A scheduling slot will be held for the Customer, and a rough date will be given for reference. However, the date may change due to cancellations of other projects, additions and/or change orders added to projects before that slot, inclement weather, and/or other factors outside of A Better Edge’s control. Deposits paid for the procurement of materials and/or the scheduling of installations are non-refundable. Please note that weather delays, employee issues, material availability, and delivery of materials are all outside the control of A Better Edge. Delays may occur for any reason and will not qualify for a refund of deposits paid. Please feel free to contact an associate if you have questions or concerns regarding your deposit.

Installation terms: Artistic license Clause The customer agrees to allow the installation crew to make minor adjustments to the plan if needed to accommodate limitations presented by landscaping or others in the designated area of installation.

Wait time: The client is asked to move vehicles or furniture so as not to obstruct access to the area to be worked. A Better Edge, Inc reserves the right to charge a wait time (to accommodate hourly employees) for all standby time waiting to move vehicles or furniture. Wait time is charged at $110 per man-hour on-site. The client also agrees that the labor rate may change if installation becomes more difficult or if hourly employees are held up due to HOA or other interfering parties. Homeowner association approval for the installation of concrete is the customer’s responsibility. Failure on the customer’s behalf to obtain homeowner association approval does not negate the customer’s contractual responsibilities. If our crew is on-site for install and is held up due to homeowner associations, neighbors, or other instances that would cause the crew to keep working, we will start a ‘wait clock’ and bill per man-hour for standby time.

Negligence: The customer agrees that newly installed concrete and other surface coatings are extremely susceptible to damage during the first 24 hours. Damage to edging caused by weather will be repaired at no charge within a reasonable time frame. All other damage to edging will require a scheduled repair at an additional charge, and payment for the original invoice must be made prior to scheduling any repairs. The client agrees to completely protect the work area from damage due to water, traffic, hoses, sprinkler systems (yours or the neighbors’), children (yours or others), wildlife, pets (yours or others), third parties, etc., during the process and for 24 hours following. Absolutely never apply tape (blue painter’s or other) to concrete coatings when they are fresh. This will cause significant damage, and the client will be responsible for repair costs. Any and all repairs needed for damage to A Better Edge products and services due to water, traffic, hoses, irrigation systems, children, wildlife, pets, third parties, etc., will be charged at a time/materials plus disposal rate.

Weather: Rain, cold, wind, and other weather events are outside our control. When a property owner demands we provide a particular service on-site, against our recommendation to hold off, where the service’s final result can be damaged by weather, those damages will not be covered by A Better Edge.

Site prep: A Better Edge, Inc. will advise the client of any deficiencies in the site preparation. Notwithstanding the foregoing, the client is responsible for the soil conditions, and by completing its work, A Better Edge, Inc. does not accept responsibility for the soil conditions. Due to possible soil movement, including but not limited to, shrinkage, swelling, and/or consolidation, and its lack of structural reliability, A Better Edge, Inc is not responsible for any damage or cracking of the concrete or segmental block wall failure and the client may be charged a service call to repair and/or replace damaged concrete or block at our current rates.

Coloration: The coloration methods we use are not paints. Therefore, it should not be expected that they will come out exactly like swatches or examples shown. An artistic license must be granted to the installer. A Better Edge, Inc. cannot be held responsible for damage caused by the unforeseen or intentional acts of other contractors, trades, or outside influences. Repairs for such will be treated and quoted as a variation of the original or new work.

Existing surface clause: When working on or over existing surfaces, we do our best to address any spalling, cracking, or other conditions that may exist on existing concrete surfaces to ensure the best appearance and longevity. We cannot, however, guarantee against future cracks, spalling, efflorescence, moisture, or other chemical imbalance in the existing substrate/slab. Nor can we warranty against new cracks, spalling, delamination, or discoloration (See note on efflorescence below) whatsoever in the new coatings, surface, or sealant. Some substrates have an intense amount of moisture or other chemical issues that are causing coatings to delaminate or flake off. When this is the case, we are unable to warrant our service or materials.

Drainage: We will reasonably attempt not to modify any existing drainage. Notwithstanding the foregoing, the Client acknowledges, understands, and agrees that the work performed uses sealants and/or coatings that will make the concrete slippery. The client agrees to indemnify, defend and hold A Better Edge, Inc. its shareholders, officers, directors, and employees, harmless from and against any and all claims, losses, liabilities, suits, demands, damages, judgments, and causes of action of any nature whatsoever which are or may be asserted by Client or any third-party against A Better Edge, Inc. for property damage or bodily injury caused, in whole or in part, by the installation of such sealants or coatings.

Walkthrough: When possible, the job site foreman will walk the job with you upon completion. This is the time to bring up any concerns and allow the team to address those concerns on site. Once the team leaves with your approval, the project is considered complete, and any additional requests that are not warranty items will be billed as a service call.

Payment terms: Payment is due in full upon completion of work in the form of a check (A returned check fee of $50 will be assessed for all returned checks), cash, or credit card. In the event that the customer will not be present during the completion of work, you can mail it to our office (address at the top of this agreement). Invoices are due and payable upon completion or receipt, and past due amounts shall bear interest at the rate of 18% per annum. We reserve the right to charge any payments not received within five (5) days of completion of work a late fee of $50. In the event of non-payment, it is the practice of our board of directors to place a mechanic’s/construction lien on the customer’s property. The client will be responsible for all costs of collection, including attorney’s fees and costs. The exclusive venue for any action arising out of or related to this agreement shall be in El Paso County, Colorado.

Maintenance and Care instructions: Colors It is important to keep in mind that our colors are not like paint swatches. Color variations are naturally occurring and expected. We appreciate the natural and artistic value of natural color variation. The concrete may look splotchy as parts of it may cure faster than others. Since stains and dyes react with the existing concrete surface, there is no potential to guarantee the various colors and how they will turn out. We will do our best to make each project exactly what each client is looking for, but often the color presents the most difficulty in achieving expected or ‘perfect’ results. When it comes to color, the old adage, ‘beauty is in the eye of the beholder,’ often takes place. Since these colors are not always perfectly consistent due to many varied reasons, we will make the best attempt possible the first time and charge time/materials for future changes. Color is affected by batching of materials, quarry contents, humidity, the moisture content of mix design, and many other factors. An exact color match to any photo, swatch, or sample should never be expected. One cause of color variation in concrete may be the natural phenomenon called efflorescence. **Efflorescence, a deposit of white salts that appears mostly as a whitish salt bloom, consists of mostly calcium carbonate. It may appear as a white powder on the surface and in no way affects the structural integrity. This phenomenon occurs in all concrete but is more visible in tinted surfaces. We generally see more efflorescence after a snowstorm or lots of rain. Although it cannot be completely prevented from occurring, efflorescence generally will weather off and disappear over time. However, A Better Edge cannot be responsible for minor or excessive Efflorescence because we have no control over groundwater, chemical deposits, water cleanliness from irrigation lines, or general chemicals in nature or in any existing surfaces. Take caution with your newly installed areas for a minimum of 24 hours after installation. If you have a contractor working for you, caution them about protecting your concrete surfaces from damage. Advise pest control companies to avoid spraying chemicals directly on concrete. Chemicals affect many concrete surfaces/products differently.

Read manufacturer’s labels cautiously before applying. As with other concrete, there is a 28-day curing process. Any and all work being done around the new concrete is the homeowner’s responsibility. To clean fertilizers and chemical stains from A Better Edge, call our office for a solution product and procedure. Advise pest control companies to avoid spraying chemicals directly on concrete. Chemicals affect many concrete surfaces/products differently.

Do not use any sealant on the concrete besides one purchased directly from A Better Edge. Not all concrete sealers are the same and you could have a chemical or mechanical bond issue when using something else. It is impossible to repair these surfaces in such a fashion that will result in a ‘failure never happened’ appearance.

The client should know this going into the project and be willing to accept living with a failure or having a repair (client pays for repairs) that is noticeable.

PAYMENT SERVICE: ABE reserves the right to reject service to any property deemed unsafe by ABE, Inc.

Photos/advertisement: The client agrees that A Better Edge, Inc. may photograph the work on the project and agrees that all photographs taken by our company or third parties shall be the property of A Better Edge, Inc. and may be used for any purpose, promotional or otherwise.

Materials: All project proposals are written with the assumption that the materials listed are available. If the pricing of, and/or availability of, materials changes between proposal acceptance and installation, the client agrees to change materials or pay the cost if it is greater.

Plant Material: This proposal includes a Warranty for included plant material installed by A Better Edge. We will warranty all plant material for a period of 90 days from the date of installation, or until October 31st of the same year, whichever comes first. A Better Edge will replace all plant material covered under warranty with the same species and size, if available, on a one-time basis. This warranty does not cover annuals or plant material not supplied by an irrigation system installed by A Better Edge. Additionally, plant damage due to frost, wind, wildlife, vandalism, or other deemed ‘acts of God’ will not be covered under warranty. The warranty period shall be void if irrigation system settings are adjusted outside those recommended by A Better Edge. A winter plant warranty may be purchased for 50% of the total plant cost. Plant material must be watered at least (1) time per month during winter, or the warranty will be void. for one year from substantial completion of the work. Replacement of plant material is for one time and one time only. Warranty shall not apply if all amounts due under this contract are not paid in full and on time. Some plants carry no warranty, such as annuals, perennials, roses, arborvitae, and a few other varieties. All Turf and non-irrigated seed carries no Warranty. Upon completion of the installation of any plant material, the Customer assumes all responsibility for establishment and maintenance. If the pricing of, and/or availability of, plant materials changes between proposal acceptance and installation, the client agrees to change the material type or pay the cost difference, whichever is greater.

Walls: Caved concrete or segmental block walls are great for adding dimension and unique texture to a landscape. If this contract includes the construction of any decorative or retaining walls, the Customer acknowledges, understands, and agrees that such walls, even when constructed in accordance with all applicable codes and industry standards may experience some movement. Movement may be caused by a number of things, including, but not limited to expansive or consolidating soils either below or adjacent to the walls, hydrostatic pressure behind the walls, and/or run-off over and/or around the walls. The customer agrees to properly maintain the walls and to ensure that adequate vegetation, grass, and/or ground cover exists on all sides of the walls so as to reduce potential damage to the walls. The customer further understands and agrees that A Better Edge, Inc. shall not be responsible for any damage to the walls, bodily injury, and/or property damage arising out of any conditions. A Better Edge’s sole responsibility is to construct the walls in accordance with industry standards. When building walls it is always preferable to taper into a slope on the ends. The client is welcome to plant trees above walls just keep in mind that tree roots may eventually cut into, and therefore, weaken any type of geo-grid or reinforcement materials used to support wall structures. Although unlikely, these types of wall failures are solely the responsibility of the homeowner. Even the best coatings and sealants can scratch. Just as you would not want to have aggressive chair and furniture legs on a fine wood floor, so too with concrete coatings. Felt furniture pads are highly recommended to help avoid scratching.

Warranty: If Client has satisfied all of its obligations under this agreement, A Better Edge, Inc. shall be responsible for any defects in materials for one year and workmanship for five years from the date of installation. All materials included in this agreement are the exclusive property of A Better Edge, Inc. Any person known or knowingly copying part or parts of this form will risk prosecution by A Better Edge, Inc. The A Better Edge brand is the official name of A Better Edge, Inc.
